1. Agreement and service
These Terms of Service govern your access to FiledNotFound and the related website, trials, subscriptions, source-linked intelligence briefs, and support (collectively, the “Service”). FiledNotFound monitors publicly available Miami-Dade County court filings, reviews qualifying source documents, and delivers business intelligence to subscribing law firms within a defined slice. The Service is intended for business use by licensed attorneys and their firms; it is not for personal, family, or household use.
2. Acceptance
By subscribing, trialing, or otherwise using the Service, you agree to these terms on behalf of yourself and the firm or organization you represent. You confirm that you have authority to bind that organization and that it will be responsible for the actions of the people who use the Service through it.
3. What FiledNotFound is—and is not
FiledNotFound is a business information service. It is not a law firm, a lawyer referral service, or a legal advice service. It does not represent consumers, evaluate the merits of a matter, predict legal outcomes, or direct who should be contacted. Using the Service does not create an attorney-client, fiduciary, or other professional relationship with FiledNotFound. Counsel independently decides whether, when, and how to use any information and remains responsible for all outreach and professional obligations.
4. Eligibility, accounts, and security
You must provide accurate business information, keep account credentials confidential, and promptly tell us about suspected unauthorized use. You may use the Service only for your firm’s own internal intake and business-development work. You may not share access outside your firm without our written approval.
5. Trials, subscriptions, billing, and cancellation
Fees, slice definitions, and plan terms are the ones presented at signup or otherwise agreed in writing. Subscriptions are month-to-month unless a written agreement says otherwise. A trial provides the agreed Service for the agreed trial period; one trial is available per firm unless we agree otherwise. You may cancel by contacting us before the end of the current billing period; cancellation takes effect at the end of that period. Amounts already paid are nonrefundable except where required by law or expressly agreed in writing.
6. Slice availability and exclusivity
Slice exclusivity is a delivery feature, not a promise of market access, case volume, or business results. While an eligible firm’s paid subscription for a defined slice remains active, FiledNotFound will not deliver the same qualifying Service brief in that slice to another firm. Exclusivity applies only to the slice and delivery scope stated at signup, does not cover public records available from other sources, and ends when the applicable subscription ends or is suspended. We may offer a released slice to another firm.
7. Permitted use and restrictions
During an active subscription, FiledNotFound grants your firm a limited, non-exclusive, non-transferable, non-sublicensable license to use delivered materials internally. You may not resell, publish, redistribute, or disclose those materials outside your firm; use them to build or train a competing data product; reverse engineer or probe the Service; remove source or ownership notices; or help another person do any of those things. Public court records cited in a brief remain subject to the public-record rules that apply to them.
8. Attorney obligations
You are solely responsible for deciding whether any communication, review, retention, or use of a brief complies with applicable law and the rules of professional conduct, advertising, solicitation, privacy, and record handling that govern your firm. You must independently verify the current official record before relying on a brief or contacting anyone. You will not represent that FiledNotFound recommended, referred, screened, endorsed, or evaluated a consumer, a matter, or your firm.
9. Public records and accuracy
Briefs are derived from public filings and public docket information available as of the delivery date. We work to read documents accurately and to flag uncertainty rather than guess, but we do not warrant that any record, date, figure, docket entry, or source document is complete, current, or error-free. The official court record controls. Please report suspected errors to hello@filednotfound.com.
10. Intellectual property and feedback
The Service, its briefs, pattern records, software, and other materials are owned by FiledNotFound or its licensors and are protected by applicable intellectual-property laws. If you provide feedback, you grant us a non-exclusive, worldwide, perpetual, royalty-free right to use it to improve the Service, without identifying you unless you agree.
11. Suspension and termination
We may suspend or terminate access for nonpayment, a material breach of these terms, a security risk, or unlawful use, with notice where practicable. On termination, your license ends and you must stop using non-public Service materials, except for records you must retain by law. Sections 3, 7 through 10, 12, and 13 survive termination.
12. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILEDNOTFOUND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CLIENTS, LOST DATA, OR MISSED DEADLINES. FILEDNOTFOUND’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE FEES PAID TO FILEDNOTFOUND FOR THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and each party consents to that venue and jurisdiction.
14. Changes and contact
We may modify the Service and these terms. For a material change, we will notify subscribed firms at their subscribed business email address before it takes effect.
